Indemnity

1. agree that I and/or any member of my family, companions, guests or employees for whom I am responsible (hereinafter collectively referred to as "the visitors") who may enter or be upon any property owned and/or controlled by Giba Gorge MTB Park for any purpose whatsoever, including but not limited to activities such as mountain biking and cycling, shall do so solely at the risk of the visitors;
2. indemnify Giba Gorge MTB Park, its directors, officers, employees, contractors and agents or any other person on Giba Gorge MTB Park property as well as surrounding landowners, Cycling South Africa and its associated commissions and clubs, event organizers, other cyclists, sponsors, officials, marshals, assistants, helpers, and any persons connected with the visitors being on Giba Gorge MTB Park property -
1. against all and any claims and/or legal proceedings whatsoever which might otherwise be made or instituted against any one or more of them by any of the visitors or by any of their dependants, executors, heirs or assigns, or by any other person for any loss caused by any visitor; and
2. against all costs, which may arise from examining, setting and/or resisting such claims and/or proceedings and in enforcing this indemnity, irrespective of whether such claims arise directly or indirectly as a result of negligence of any company or person, be it gross or otherwise, and/or wrongful act or omission; and
3. waive any right to claim against such as is described in paragraph 2 hereof, which I or my estate might otherwise have had against the companies and or persons identified in paragraph 2 hereof.
